The documented payment
The SEC found that Kim Kardashian received $250,000 to publish an Instagram post about EMAX tokens without disclosing that payment. On 3 October 2022 it announced a settlement of $1.26 million, including a penalty, disgorgement and interest. Kardashian settled without admitting or denying the findings and agreed not to promote crypto asset securities for three years.
Why the disclosure mattered
The financial relationship was directly relevant to how followers evaluated the post. Fame did not establish technical due diligence or the suitability of the asset. A link to instructions for buying the token made the post part of a purchase path, not merely a detached comment about technology.
This case is about the documented promotion and settlement. It should not be rewritten as a criminal conviction or proof that every person discussing EMAX was paid.
