New Twitter: X vs Operation Bluebird
A legal battle over the Twitter brand is unfolding. X Corp, owned by Elon Musk, has filed a federal lawsuit against the startup Operation Bluebird.
Operation Bluebird petitioned the United States Patent and Trademark Office to cancel X Corp’s trademarks for “Twitter” and “Tweet”. The startup argues that the 2023 rebrand to X constitutes legal abandonment of the Twitter brand. It plans to relaunch a platform under the name Twitter new and claims around 150000 user signups.
X Corp rejects this claim. In its lawsuit, the company states that the Twitter brand is still actively used. Millions of users access the platform via twitter com, posts are still commonly called tweets, and Twitter branding remains visible across the ecosystem. X Corp argues there was no intent to abandon the mark and accuses Operation Bluebird of trademark infringement.
The case now moves through federal court and trademark proceedings. Under US law, non use over several years can indicate abandonment, but continued public and commercial use can preserve rights.
