2021–2023: Gemini Earn connects a retail interface to Genesis credit risk

Follow the borrower

The SEC's January 2023 complaint described Gemini Earn as a programme in which users lent crypto assets to Genesis while Gemini acted as an agent. According to that filing, the retail programme began in February 2021 and Gemini deducted a fee from the returns Genesis paid.

The complaint stated that Genesis stopped allowing Earn withdrawals in November 2022 because it lacked sufficient liquid assets. At that point it held approximately $900 million belonging to 340,000 Earn investors. These are the figures in that historical filing, not a current unpaid-balance estimate.

The interface can hide the second balance sheet

A customer using one company's app may become exposed to another company's borrowing decisions. The important questions are which entity owes the assets back, what the intermediary promises, what discretion the borrower has and whether either balance sheet can be inspected.

The January 2023 filing alleged unregistered offers and sales. An allegation in that document should not be silently upgraded into a criminal conviction or used to describe every later proceeding. Its lending structure remains a concrete example of counterparty links and the source of interest even when later settlements or repayments change the case status.
